1. Acceptance of Terms
By accessing or using the Mukhota application, website, and related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.
Our platform is exclusively designed for individuals 13 years of age or older. By using Mukhota, you represent and warrant that you meet this age requirement.
2. Description of Service & Principle of Anonymity
Mukhota provides an anonymous peer-support platform where users can share their thoughts, seek advice, and engage in discourse without revealing their real-world identities. While we provide the tools for anonymous communication (including end-to-end encrypted direct messaging), anonymity is a tool for vulnerability and support, not a shield for abuse.
3. Community Guidelines & Prohibited Conduct
To maintain a safe and supportive environment, you agree not to engage in any of the following prohibited activities:
- Hate Speech & Harassment: Posting content that promotes violence, attacks, or harasses individuals or protected groups based on race, ethnicity, religion, disability, age, nationality, veteran status, sexual orientation, gender, or gender identity.
- Doxxing: Sharing Personally Identifiable Information (PII) of yourself or others, including but not limited to real names, phone numbers, addresses, or workplace details.
- Spam & Manipulation: Engaging in spamming, phishing, scraping, or utilizing malicious automated bot activity to manipulate platform metrics (e.g., vote manipulation).
- Illegal Activity: Using the Service for any unlawful purpose or to promote illegal activities.
Violating these terms will result in an immediate, irretrievable ban. We utilize Google Perspective API for automated toxicity detection; consistently toxic behavior triggers our Shadowban system.
4. Automated Moderation & Crisis Intervention
Mukhota employs automated tools to enforce our Community Guidelines and protect user safety:
- Toxicity Detection: Content may be automatically analyzed prior to publication. Content exceeding our toxicity thresholds may be shadowbanned or permanently removed without notice.
- Crisis Intervention: While Mukhota is not a medical platform, user safety is paramount. If our systems detect keywords indicating imminent self-harm or suicidal ideation in your draft post, we may automatically intervene to provide crisis hotline resources (e.g., iCall, Vandrevala Foundation) rather than publishing the content to the public feed.
5. User Content & Intellectual Property
You retain full ownership of any intellectual property rights that you hold in the content you post ("User Content"). However, by publishing on Mukhota, you grant us a worldwide, royalty-free, non-exclusive license to use, distribute, reproduce, modify, adapt, publicly perform, and publicly display such User Content strictly for the purpose of operating, promoting, and improving the Service.
6. Disclaimers & Limitation of Liability
A. No Medical or Professional Advice
Mukhota provides a space for peer-to-peer discourse. We do not provide professional medical, legal, or psychological advice. If you are experiencing a life-threatening crisis, please contact your local emergency hotline immediately.
B. "As Is" Basis
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Mukhota expressly disclaims all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
C. Limitation of Liability
To the fullest extent permitted by applicable law, in no event shall Mukhota, its creators, affiliates, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Service; (b) any conduct or content of any third party on the Service.
7. Indemnification
You agree to defend, indemnify, and hold harmless Mukhota, its officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.
8. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in Bengaluru, Karnataka, India, and the parties hereby irrevocably consent to the personal jurisdiction and venue therein.
9. Modifications to Terms
We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last Updated" date. You are advised to review these Terms periodically for any changes. Your continued use of the Service after any modification constitutes your acceptance of the updated Terms.
